Court Ruling Offers Early Look at How Ambient AI Recordings May Be Treated

As physicians increasingly use AI tools to assist with clinical documentation, a recent Washington court ruling offers an early indication of how the law may treat the recordings behind those systems. A trial court ruled that an ambient audio recording used to help generate a clinical note served an administrative purpose and was not part of the medical record a patient was entitled to access under Washington law. Medical organizations, including the AMA, argued that such recordings should be treated similarly to dictation, handwritten notes and other tools used to create the final patient record.
